Refacely is an online image processing service powered by artificial intelligence, providing features such as image enhancement, upscaling, denoising, and detail refinement.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

2. Eligibility

You must be at least 16 years old to use the Service.

If you use the Service on behalf of a company or organization, you represent that you have the legal authority to do so.

You are responsible for all activities that occur under your account, including keeping your login credentials secure.

3. User Content and Copyright

You retain all rights to the images, assets, and generated results you upload or create using the Service ("Content").

You grant us a limited license to process your Content solely for the purpose of providing the Service and delivering results.

We do not publicly display, distribute, or use your Content for model training without your explicit consent.

You are responsible for ensuring that your Content complies with applicable laws and does not infringe upon any third-party intellectual property or privacy rights.

If we discover Content that is illegal or infringing, we may remove it and suspend or terminate the associated account.

Uploaded images are automatically deleted within 72 hours after the job is completed.

5. Payments and Billing

Some features of the Service are paid. You will be clearly informed of applicable fees and billing cycles before payment.

All payments are processed through secure payment providers.

Once a job has started processing, fees are generally non-refundable unless we are unable to deliver the Service due to a system failure or similar issue.

If we detect fraudulent or abusive activities, we may suspend or terminate access to your account.

6. Prohibited Conduct

You agree not to use the Service to:

• Upload illegal, harmful, pornographic, violent, or infringing content.
• Reverse engineer the platform, abuse APIs, send automated traffic, or otherwise attempt to compromise system security.
• Offer paid intermediary or reselling services based on Refacely without our prior written permission.
• Engage in any activity that violates applicable laws or harms the rights and interests of others.

If you violate these rules, we may immediately suspend or terminate your account and delete related data.

7. Service Interruptions and Disclaimers

We strive to keep the Service stable and available, but we do not guarantee uninterrupted or error-free operation.

We are not liable for losses caused by network issues, device failures, system errors, force majeure events, or other circumstances beyond our reasonable control.

You understand and agree that image processing results may be limited by algorithms and we do not guarantee any particular visual outcome.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service.

In any case, our total aggregate liability will not exceed the amount you have paid for use of the Service.

9. Intellectual Property

All software, website design, trademarks, text, images, and algorithms of Refacely are protected by intellectual property laws.

You may not copy, modify, distribute, or use them for commercial purposes without our prior written consent.

10. Termination

We may suspend or terminate your access to the Service in the following circumstances:

• You violate these Terms or applicable laws.
• We determine that suspension is necessary to protect system security or the rights of others.
• We are unable to continue offering the Service due to force majeure or regulatory changes.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, USA.

In the event of a dispute, the parties will first attempt to resolve it amicably. If that fails, the dispute will be submitted to the courts of Colorado.
